Referral Bonus Programme: Terms & Conditions
Midget Squid issues this document.
The company shall be known throughout this document as Midget Squid. This
document was last modified on 5th July 2007.
In General
Midget Squid currently offers a Referral Bonus Programme to
all of its web hosting account holders. By participating, you acknowledge
that you have read, understood and agree to be bound by these Terms and
Conditions.
Eligibility
This Bonus is open to all Midget Squid web hosting account holders. Midget
Squid reserves the right to discontinue this programme at any time within
thirty days of notifying users. Should the programme be discontinued,
you will receive the full bonus for new clients you have referred under
the following terms.
Persons Who May Be Referred
You must only refer Midget Squid to individuals and businesses with whom
you have a pre-existing personal or business relationship.
Without limiting the generality of the foregoing, you must not obtain
names for referral from i) group email addresses or ii) third party bulk
mailing lists, customer lists or e-mail lists. You must not submit yourself
for this referral bonus. You will not be eligible for a bonus for referring
a business that signs up for a Midget Squid web hosting account during
a reduced fee promotional offer period.
No Spamming
We strictly forbid the sending of unsolicited email to numerous recipients
("spamming") and any Midget Squid user who spams other Internet
users for referral bonuses will have his or her hosting account immediately
suspended. See our Acceptable
Use Policy and Terms of Service for additional
information.
No Improper Usage
You also agree not to use the text links or
image links in any manner that could damage, disable, overburden, or
impair the Site or any other site, create spam or any other unwanted
solicitation, or interfere with any other party’s use and enjoyment
of the Site, their own site or other location of the text links or image
links. You agree that you will not paste, copy or otherwise impose the
text links or image links anywhere without the consent of the proper
authority. Midget Squid is not responsible for anything that you do with
the text links or image links. You agree not to use any of our trademarks
or intellectual property or make any representations, warranties or other
statements concerning Midget Squid, the Site or any of our products,
services or policies, except as detailed in this Agreement.
Number of Referral Bonuses
For a limited time, there are no restrictions on the number of Referral
Bonuses you may earn.
Bonus Requirements
For each customer that you refer to Midget Squid who completes the new
account bonus requirements below, we will credit a bonus, under the following
guidelines, to your Midget Squid web hosting account. A "Successful Referral"
is one that we determine satisfies each of the following criteria:
- the referred customer (a "New Client") must not be a current
or past customer of Midget Squid and must sign up for a web hosting
account;
- there must be a bona fide purchase by the New Client of a web
hosting account for which payment is received by Midget Squid and is
not reversed
or otherwise set aside as a potentially false transaction;
- the New
Client must reach the Site by clicking on a text link or image link
received by you through the Referral Bonus Programme interface,
and not
be a result of you creating spam or doing anything that would bring
the Programme or Midget Squid into any kind of disrepute;
- the New
Client must have cookies enabled on their browser when clicking on
your link to the Site, when reaching the Site, and
when completing
the membership application (otherwise we can't track it);
- when
coming to the Site and making the required purchase, the New
Client must still have the cookie enabled that was placed
on their
computer when
clicking on the text link or image link to the Site. This means
the purchase must be within 14 days of clicking the text link
or image
link.
All bonuses which are payable will be credited to your hosting account
and may be adjusted to reflect actual receipts or artificial transactions
in accordance with the terms of the Programme or Midget Squid's
discretion. Any credited amounts will be discounted from your next web
hosting bill.
Midget Squid reserves the right for any reason to refuse any New Client
application
or purchase transaction in its discretion, without notice or any communication
to you. Payment of Fees and amendments to the Programme are at the sole
discretion of Midget Squid. Under no circumstances shall Midget Squid be
required to provide you with any information or updates regarding the New
Client, except to confirm the referral.
For all referrals, you must have a Midget Squid web hosting account in
good standing. You
agree to actively refer potential new clients to the Site. For each Successful
Referral Midget Squid will credit you with an amount
equal to 5% of the New Client's first annual web hosting bill.
Payout Period
You are only eligible to receive a Referral Bonus for the first year of
a New Client's web hosting account ownership. Bonus discounts can only
be applied to
your next web hosting bill. If as a result of of accruing bonus discounts
your next web hosting bill has been paid in full and you are
still in credit, any surplus will be carried on to the following year's
bill.
If, however, you do not renew your web hosting account with Midget
Squid, and therefore do
not
receive
any bonuses that may have accrued during your last year of hosting, then
those bonus discounts will have been forfeited. In this and all situations
there is no cash alternative for bonuses accrued.
Method of Referral
To receive credit for referring a New Client, the Merchant must sign up
for his or her Midget Squid web hosting account by going to the Midget
Squid
site through your referral link.
Additional Terms and Conditions
Midget Squid reserves the right to discontinue the Bonus
for any reason, at any time and for any duration at its sole discretion,
and without notice.
Remedies for Your Non-compliance
If Midget Squid determines in its sole discretion that you have not complied
with these Terms and Conditions, it may, in addition to any other rights
and remedies it may have against you, immediately and without notice
to you, withdraw all benefits to you under the Bonus (including, without
limitation, by cancelling or declining to credit any and all refunds
issued or to be issued to you in connection with the Bonus and, by declining
to send or stopping from being sent, any Bonus payments).
Limitation of Liability for Midget Squid
TO THE FULLEST EXTENT PERMITTED BY LAW, NEITHER MIDGET SQUID NOR ANY OF
ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES OR OTHER REPRESENTATIVES
WILL BE LIABLE FOR DAMAGES ARISING OUT OF OR IN CONNECTION WITH THIS
OFFER. THIS IS A COMPREHENSIVE LIMITATION OF LIABILITY THAT APPLIES TO
ALL DAMAGES OF ANY KIND, INCLUDING (WITHOUT LIMITATION), DIRECT, INDIRECT,
OR CONSEQUENTIAL DAMAGES; LOSS OF DATA, INCOME, OR PROFIT; LOSS OF OR
DAMAGE TO PROPERTY; AND CLAIMS OF THIRD PARTIES.
Entire Agreement
These Terms and Conditions represent the entire agreement between you and
Midget Squid with respect to the Bonus.
Variation of the Terms and Conditions
These Terms and Conditions may be amended by Midget Squid in its sole discretion
at any time and these amendments will apply to you when you next use
the Midget Squid service. Any such amendments will be posted to this
page, and it is your responsibility to review this page from time to
time for such amendments.
Severance
If any provision of these Terms and Conditions is held to be invalid, such
invalidity will not affect the remaining provisions.
Governing Law
These Terms and Conditions will be interpreted, construed and enforced
in all respects in accordance with the laws of Scotland. You hereby irrevocably
consent and submit to the nonexclusive jurisdiction of the Scottish courts.
Failure to comply with any of our terms & conditions will result
in grounds for immediate account deactivation.
Midget Squid reserves the right to change, edit,
or update the policies contained in this document at any time for any
reason without notice.
